The rules of using Hiva.

These terms govern your access to and use of Hiva. Read them in full — they set out what we promise, what we don't, and what we expect from you in return.

Don't scrape or resell

Personal use only. Bulk extraction, resale, or training third-party models on Hiva data is prohibited.

Limited liability

Our maximum liability to you is capped at the fees you paid Hiva in the prior 12 months.

Singapore-governed

These terms are governed by Singapore law. Disputes are resolved in Singapore courts.

Updates with notice

Material changes are announced by email at least 14 days before they take effect.

1. Acceptance of these terms

By creating an account, paying for a subscription, or otherwise using Hiva (“the Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. About the Service

Hiva is a Singapore property intelligence platform that aggregates public market data — URA caveats, government open data, OneMap, MAS, and Google Places — and computes scores, rankings, and comparisons across Singapore residential projects. The Service is operated by Hiva Pte. Ltd., a company registered in Singapore.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract under Singapore law to use the Service. By signing up you confirm that both conditions apply to you. Hiva is not designed for use by minors and we do not knowingly accept accounts from them.

4. Your account

You are responsible for:

  • Keeping your login credentials secure and not sharing them.
  • All activity that occurs under your account, whether or not authorised by you.
  • Providing accurate information at signup and keeping it up to date.
  • Notifying us promptly at hiva.sg@gmail.com of any unauthorised access.

We may suspend or close accounts that show signs of compromise, abuse, or violation of these Terms.

5. Subscriptions, billing, and refunds

Hiva offers a free tier and one or more paid plans (currently Analyst and Studio). Paid plans are billed in advance on a monthly or annual basis through our merchant of record, Paddle, which handles payment, sales tax, and invoicing.

  • Auto-renewal. Paid plans renew automatically at the end of each billing period until cancelled.
  • Cancellation. You may cancel any time from the Settings page. Your plan stays active until the end of the current billing period and you will not be charged again after that.
  • Refunds. Fees are non-refundable except where required by law or where we have made a material error in billing. Discretionary refunds may be offered for service outages or material defects.
  • Price changes. We may change subscription prices with at least 30 days' notice by email. Price changes take effect at your next renewal.
  • Taxes. Prices shown may exclude GST or other local taxes, which Paddle adds at checkout based on your billing location.

6. Acceptable use

When using the Service, you agree NOT to:

  • Use automated tools to scrape, crawl, or bulk-extract data beyond what the documented public API allows.
  • Resell, redistribute, sublicense, or repackage Hiva data, scores, or rankings to third parties.
  • Use Hiva data to train or fine-tune machine-learning models without our prior written consent.
  • Circumvent rate limits, paywalls, authentication, or other technical restrictions.
  • Reverse-engineer the Service, decompile binaries, or attempt to derive source code.
  • Use the Service to violate Singapore law, infringe intellectual property, or harass any person.
  • Upload or transmit malware, viruses, or other harmful code.
  • Misrepresent your identity, affiliation, or the source of information shown by Hiva.

Violation may result in immediate suspension, termination, and forfeiture of pre-paid fees.

7. Intellectual property

The Service — including the Hiva name, logo, scoring methodology, sleeve definitions, rankings, code, design, and editorial content — is owned by Hiva Pte. Ltd. or our licensors and is protected by Singapore and international copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use, subject to these Terms.

Inputs you provide to Hiva (e.g., saved searches, watchlists, AI shortlist prompts) remain yours. By submitting them, you grant Hiva a worldwide, royalty-free licence to process them as needed to operate the Service and improve it. We do not use your personal inputs to train third-party AI models.

8. Property data and scoring is not financial advice

Important. Hiva is a research and information tool. Scores, sleeves, rankings, AI shortlists, and editorial content are not financial, investment, legal, tax, or property advice, and they are not a recommendation to buy, sell, or hold any property. You are solely responsible for any decision you make, and you should verify all material information with a licensed property agent, valuer, mortgage broker, solicitor, accountant, or other qualified professional before transacting.

Property data on Hiva is built from public sources. We make reasonable efforts to keep it accurate and current, but we do not warrant that any specific data point, score, or ranking is complete, current, or free from error. Markets move, data providers update on their own schedules, and methodology is updated periodically.

9. Third-party services

The Service relies on third-party providers, including (without limitation) Auth0 (identity), Paddle (payments), Anthropic (AI), Railway (hosting), Cloudflare (CDN), Google Places (POI data), URA, OneMap, and data.gov.sg. Your use of those features is additionally subject to those providers' own terms. Hiva is not responsible for the acts, omissions, or downtime of third-party providers.

10. Service availability and changes

We aim to keep Hiva continuously available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We may also change scoring methodology, sleeves, factor weights, plan features, and limits as the product evolves. Where a change materially reduces what you receive on a paid plan, we will give at least 14 days' notice and offer a pro-rata refund for the unused portion of your billing period.

11. Suspension and termination

You may stop using the Service at any time and delete your account from Settings.

We may suspend or terminate your access without refund if we reasonably believe you have breached these Terms, used the Service in a way that creates risk for Hiva or other users, or where required by law. On termination, your right to access the Service ends immediately; clauses that by nature survive termination (e.g., intellectual property, limitation of liability, indemnification, governing law) will continue to apply.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted operation. Hiva does not warrant that any score, ranking, projection, or other output will be accurate or will yield any particular outcome.

13. Limitation of liability

To the maximum extent permitted by law, Hiva and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, revenue, data, or goodwill — arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is limited to the total fees you paid Hiva in the 12 months immediately preceding the event giving rise to the claim, or SGD 100, whichever is greater. Nothing in these Terms excludes liability that cannot lawfully be excluded (e.g., for death or personal injury caused by negligence, or for fraud).

14. Indemnification

You agree to indemnify and hold Hiva harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of any law or third-party right; or (d) any decision you make in reliance on the Service.

15. Governing law and dispute resolution

These Terms are governed by the laws of Singapore, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be submitted to the exclusive jurisdiction of the courts of Singapore, unless we mutually agree to arbitration administered by the Singapore International Arbitration Centre (SIAC) under its then-current rules.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
